Terms & Conditions
1. It is agreed that the terms set out in this document is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
2. The Photographer
On occasions, and without notice, it may be necessary for the photographer originally specified to be substituted by another photographer.
All image sizes are nominal, The photographer(s) will provide a pleasing colour balance but can not guarantee exact colour matching.
Retouching and digital manipulation is available at the client’s request. There may be an additional charge for this service.
Copyright for all images remains with us and images must not be reproduced in any form without our permission. However, if you purchase any images in digital format, you will be provided with a Copyright Certificate granting permission to reproduce images as you wish. Any images or copies of images, whether stored digitally or othersiwe, and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the photographer(s) in writing. Any breaking of seals in the viewing prints will presume a breach of copyright.
6. Digital Files
Digital files remain the property of the photographer(s), unless otherwise stipulated.
The photographer(s) shall be granted complete artistic licence including in relation to the poses photographed. The photographer(s) judgement regarding the poses and number of images taken shall be final.
8. Force Majeure
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
The client hereby allows the photographer(s) to display any images included in this contract in their studios, portfolios, literature, exhibitions and advertising. No use of the images will be made by the photographer(s) for other commercial reason except with written permission of the client.
The client may cancel their photo shoot at any time by calling the photographer(s) or giving written notice to the photographer(s) and in doing so shall forfeit the booking fee previously paid (if applicable). The client may cancel order of goods made through the studio within 48 hours of making the order without incurring a charge. If the client cancels the order of goods after 48 hours the full order payment will be charged.
Any complaints should be raised by the client with the photographer(s) in writing, over the phone or face to face within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
In the unlikely event that you are not happy with the outcome of your photo shoot, a full refund of the booking fee will be given. If you are not satisfied with the quality of your goods upon collection of order, the order will be replaced until you are satisfied.
We may use your data to advise you of products, services and special promotions provided by us. We may contact you by post, telephone, text message or email. you cn opt out from receiving information from us at any time by writing to us at: Helter Sketler Photography, Unit 4, Hawthorn Rise, Tibberton, Droitwich, Worcestershire WR9 7NU.
By booking a photo shoot with Helter Skelter Photography, it is understood that you are in acceptance of the Terms and Conditions as detailed.
